Terms of Service
The rules that apply when you use DeskcommCRM.

1. Agreement
These Terms of Service govern your access to and use of deskcommcrm.lol and the DeskcommCRM service (the "Service"). By creating a workspace, signing in or paying for a plan you accept these terms. If you accept them for a company, you confirm that you are authorised to bind that company.
2. What the Service does
DeskcommCRM is a commercial operating system for teams that sell through messaging. It runs AI agents that answer and qualify leads on WhatsApp, applies a series of checks before outbound messages are sent, moves leads through a funnel, schedules follow-ups, classifies stalled demands on the Radar and keeps an audit trail of the actions taken.
The Service is a tool, not a party to your sales. You remain responsible for your offers, prices, promises and commercial results.
3. Accounts
Accounts are created with Google sign-in. You are responsible for the activity of the seats you invite and for keeping access to the Google account used to sign in secure. Tell us immediately if you believe a seat has been compromised.
4. Plans, billing and renewals
Paid plans are subscriptions billed through Stripe, monthly or annually, in advance. Subscriptions renew automatically at the end of each period until cancelled. Annual plans are billed once for twelve months.
Prices are shown on the pricing page and may change for future periods with notice. Taxes may apply depending on your location.
5. Acceptable use
You agree to use the Service lawfully and in line with the rules of the messaging channels you connect. In particular you agree not to:
- send unsolicited bulk messages, or message people who asked not to be contacted;
- use the Service to mislead, impersonate, defraud or harass anyone;
- upload material you do not have the right to use, or content that is illegal;
- attempt to reverse engineer, resell or overload the Service outside your plan;
- use the Service where its use would break the terms of WhatsApp or any other connected platform.
- We may suspend a workspace that puts the platform, other customers or recipients at risk. Where it is reasonable to do so, we tell you first and give you the chance to fix the problem.
6. Your data and your customers
You keep ownership of your workspace data: your material, your conversations and your records. You grant us the licence needed to host, process and display that data in order to run the Service, and to use aggregated, de-identified measurements to keep it reliable.
You are the controller of the personal data of your customers. You are responsible for having a lawful basis to contact them, for telling them that automation may answer, and for honouring their requests about their own data.
7. AI limitations
The agents generate responses automatically. The checks in the Service reduce the risk of an out-of-policy promise, but no automated system is free of errors, and model output can be wrong or incomplete. Keep a human accountable for what your desk says, and use the audit trail and the handoff features to review consequential conversations.
8. Service availability and changes
We work to keep the Service available and to improve it. We may change or remove features, and we may perform maintenance that temporarily interrupts the Service. Where a change materially reduces what your plan includes, we will give reasonable notice.
9. Suspension and termination
You can cancel at any time from your account settings; the plan stays active until the end of the period you paid for. We may suspend or terminate a workspace for material breach of these terms, for non-payment, or where required by law. On termination your right to use the Service ends, and we handle your data as described in the Privacy Policy.
10. Intellectual property
The Service, its software and its brand belong to us or our licensors. These terms do not transfer ownership of the Service to you. Feedback you send us may be used to improve the Service without obligation.
11. Disclaimers and liability
The Service is provided "as is" and "as available", without warranties beyond those that cannot be excluded by law. To the maximum extent permitted by law, we are not liable for indirect or consequential losses, lost profits, or lost sales opportunities.
Our total liability for any claim relating to the Service is limited to the amounts you paid us in the twelve months before the event giving rise to the claim.
12. Governing law and contact
These terms are governed by the laws applicable at our place of business, without prejudice to mandatory consumer protections in your country of residence.
